User Service Agreement

This User Service Agreement (hereinafter referred to as "this Agreement" and "the Agreement") is concluded between Apollo-Explorer (hereinafter referred to as "we" and "us") and you regarding the use of Apollo-Explorer related products or services. Before you register an Apollo-Explorer platform account and use the related services of the Apollo-Explorer platform, you shall carefully read and fully understand the terms of this Agreement and the Privacy Policy, in particular the terms limiting or exempting our liability, applicable law and dispute resolution (such terms will be displayed in bold font). If you cannot accurately understand any of the terms of this Agreement, please do not register or use the related products and services of the Apollo-Explorer platform, and you shall contact us in a timely manner (official customer service email: info@apollosuite.com).

If you follow the instructions on the registration page and complete Apollo Explorer account registration by filling in information, reading and accepting this Agreement as prompted on the registration page , or if you actually use the Service in other ways permitted by Apollo Explorer , it means that you have fully understood and voluntarily accepted the entire contents of this Agreement and all rules related to this Agreement that have been or may be issued by the Platform in the future, including but not limited to page display, policies, announcements, operating procedures or notifications, etc. We reserve the right to modify this Agreement and rules at any time, and we will notify you of the modified content by means of an on-platform notice. Please review the latest version of the Agreement and rules on the Apollo-Explorer platform in a timely manner. After being notified of the changes to the terms of the User Agreement, if you do not agree to the relevant changes, you may stop using our services. If you continue to use the Apollo-Explorer platform, it will be deemed that you are aware of and agree to such revisions.

Section 1: Description of Service Content

a. Apollo-Explorer provides you with comprehensive new media data retrieval, analysis, operation and management services. Such services may be optimized and updated according to user needs, specifically subject to the content displayed on the Apollo-Explorer platform page.

Sectiion 2: Account Registration and Use

a. Account Registration

1) You understand and acknowledge that you must have full civil capacity to use the Apollo-Explorer Platform Services. If you are a natural person who does not have full civil capacity for civil behavior, you and your guardian shall bear all the consequences arising therefrom in accordance with the law. If you register an Apollo-Explorer Platform account on behalf of a legal person or other organization, you undertake that you have obtained sufficient prior written authorization from the legal person or other organization on whose behalf you are registrering in advance, and such legal person or other organization will be bound by this Agreement.

2) You understand and acknowledge that you must register a user account to use the services of the Apollo-Explorer platform. You may register and obtain a user account on Apollo-Explorer Platform by filling in the relevant information as prompted on the page. You undertake that the information you submit to Apollo-Explorer is true, lawful, accurate and valid. If the identity information you submit is incomplete, untrue or not verified, you may not be able to use the relevant services of Apollo-Explorer and will not receive any compensation.

If your personal information changes, you shall modify and update it in a timely manner. Otherwise, you shall be responsible for the inability to exercise your rights fully and effectively. For any issues arising therefrom, Apollo Explorer has the right to cancel your user qualification without any compensation or refund of the corresponding fees you have paid. You shall be responsible for the corresponding legal liability and adverse consequences thereof.

b. Account Utilization

1) After your account registration is completed, you may log in to the Apollo Explorer Platform using your registered account and password.

2) You understand and acknowledge that you shall keep your account information properly and ensure that you will not provide your account information to anyone else, otherwise you shall be responsible for all losses arising therefrom.

3) You understand and agree that your account is for your personal use only. We will only ask you to provide relevant information when it is related to the security of your account. If you have any questions about this, please contact our official customer service before providing it. Please make sure you keep your account information safe and take full responsibility for all activities carried out with the account information. You shall not lend, transfer or in any way provide your account for use to any third party other than yourself without legal provisions, judicial rulings or without the consent of Apollo-Explorer. Otherwise Apollo-Explorer has the right to hold you liable for any breach of contract, and you shall be solely responsible for all liabilities arising therefrom. If Apollo-Explorer discovers or has reason to suspect that the user is not the initial registrant of the account, Apollo-Explorer reserves the right to refuse to provide corresponding services, freeze or recover the registered account or terminate this Agreement, and may require you to compensate Apollo-Explorer for the losses suffered, and you shall bear the losses including but not limited to the interruption of user communications, the clearing of user data and information, etc.,

4) If you find any unauthorized login or other occurrences that may affect the security of your account, please contact us in time and agree to authorize us to process relevant information to maintain the security of your account. Otherwise, Apollo-Explorer will not bear any responsibility for the potential damages incurred or extend.

You acknowledge and agree that if you lose or leak your account due to any negligence in the safekeeping of account information and the network security maintenance of related Internet devices, which is not attributable to us, you shall be responsible for any consequences arising therefrom, and Apollo-Explorer shall not be liable for such consequences. If Apollo-Explorer incurs related expenses as a result of such loss or leakage from you, Apollo-Explorer shall have the right to claim compensation from you.

Section 3: About service fees

a. You understand that Apollo-Explorer has incurred significant costs in operating the platform therefore some services of the Apollo-Explorer platform will be provided to you for a fee. You understand and agree that the charging items, charging standards, charging methods and other rules displayed on the Apollo- Explorer platform may be modified or changed from time to time, and the specific details shall be subject to the display of the Apollo-Explorer platform. If you do not agree to such modifications or changes, you may stop using the Apollo-Explorer platform services.

b. You understand and agree that service fees, once paid, are non-refundable without the written consent of Apollo-Explorer.

c. Apollo reserves the right to ban the User’s account and will not provide a refund if the User improperly accessed Apollo-Explorer platform data through illegal technical means such as scripts

Section 4: Statement of Use and Commitment

a. You undertake that the information you provide to us in the course of registration and use of the Apollo-Explorer Platform is true, accurate, lawful and valid, otherwise you shall bear all liabilities arising therefrom.

b. You undertake that, you shall abide by the laws, regulations, rules and regulations and the rules issued from time to time by Apollo-Explorer in the process of using the Apollo-Explorer Platform, and you shall not use the Apollo-Explorer Platform to engage in any illegal or unlawful profit-making activities.

c. You may share and exchange information on the Apollo-Explorer Platform, but you must ensure that the information you share on the Apollo-Explorer Platform complies with laws and regulations and the requirements of this Agreement, otherwise all responsibilities arising therefrom shall be borne by you, and we have the right to delete such information.

Section 5: Intellectual Property Rights

a. Unless otherwise agreed or stated, the intellectual property rights of the content (including but not limited to web pages, texts, images, audio, video, graphics, etc.) provided by the Apollo-Explorer platform and the software on which the platform relies belong to Apollo-Explorer . No one may use or create related derivative works in any form without the written permission of Apollo-Explorer or the relevant rights holder.

b. You may provide content (including but not limited to text, images, audio, video, graphics, etc.) to Apollo-Explorer by publishing, commenting, and etc, when you use the Apollo-Explorer platform service. In such cases, you may enjoy the complete intellectual property rights of such content, and at the same time, you shall bear all liabilities in relation to such content. You grant Apollo-Explorer a worldwide, free license to allow Apollo-Explorer to use, reproduce, disseminate, modify, compile, sublicense, create derivative works from, publish and perform such content.

Section 6: Statement of liability for breach of contract

Except as otherwise agreed in this Agreement, if you violate the provisions or undertakings of this Agreement, it will constitute a breach of contract. Apollo Explorer reserves the right to take one or more measures in its sole discretion and without notice, including but not limited to:

• a. Suspend or terminate the provision of services;
• b. Request compensation from you to indemnify all direct or indirect losses incurred by Apollo-Explorer as a result , including losses arising from third parties claims against Apollo-Explorer ;
• c. Hold you liable for breach of contract.

Section 7: Exemptions and Disclaimers

You fully understand and agree that:

a. In the course of your use of the Apollo-Explorer platform services, you may encounter risk factors such as service interruptions, malfunctions, obstacles, delays, nonscheduled system upgrades or force majeure, which may cause service interruptions or terminations. You agree that Apollo-Explorer shall not be responsible for service interruptions or terminations caused by any of the following circumstances:

• (1) Force majeure. Force majeure refers to objective events that cannot be foreseen, overcome or avoided and that have a significant impact on one or both parties, including but not limited to natural disasters such as floods, earthquakes, epidemics and storms, and social events such as wars, turmoils, government actions, legal or policy adjustments, platform rule adjustments, etc.;
• (2) Damage caused by computer viruses, Trojans or other malicious programs, or hacker attacks;
• (3) Failure of Apollo Explorer or your computer software, system, hardware and communication lines;
• (4) Improper operation on your part;
• (5) You use the Service in any manner not authorized by Apollo Explorer ;
• (6) Other circumstances beyond control or reasonable foreseeability.

b. With respect to products and services, Apollo Explorer disclaims any kind of express or implied warranties or conditions, including but not limited to, commercial merchantability , fitness for a particular purpose, etc. Users shall bear the corresponding risks for the use of their accounts.

c. You shall make your own judgment on the content provided by this service and bear all risks arising from the use of the content, including the risks arising from reliance on the correctness, completeness or practicality of the content. The use of any article or information on this website shall be at the user’s sole discretion and risk. Any loss or data loss arising out of the use of any article or information shall be borne by the user. Apollo Explorer cannot and will not be liable for any loss or damage arising out of aforementioned risks. Unless otherwise expressly stated in writing, andin compliance with laws and regulations, Apollo Explorer does not make any form of express or implied statement or warranty, regarding the information, content, materials, products or services on its website and client.

d. Any advice or information you obtained from Apollo Explorer in connection with the products or services, whether in writing or orally, shall not constitute any warranty beyond this Agreement, other than as expressly set forth in this Agreement.

e. As you use the products or services provided by Apollo-Explorer , the software may invoke a third-party system or support the user's use or access through a third party. The results of the use or access will be provided by the third party. Apollo-Explorer does not guarantee the security, accuracy, effectiveness and other uncertain risks of the services and content provided by third parties. Apollo-Explorer shall not be responsible for any disputes and damages arising therefrom and shall not be liable for any such disputes or damages.

Section 8: Information Protection Statement

a. Apollo Explorer attaches great importance to the protection of your personal information. Apollo Explorer will collect, store, disclose and use your personal information in accordance with the Privacy Policy published on the Apollo Explorer platform. You acknowledge that you have fully understood and agreed to the Privacy Policy published on the Apollo Explorer platform.

Section 9: Others

a. By registering and using Apollo-Explorer’s products or services, you acknowledge that you have read and agree to be bound by this Agreement.

b. This Agreement is signed in Hangzhou, People's Republic of China.

c. The laws of the People’s Republic of China (excluding conflict of laws) shall apply to the establishment, effectiveness, performance, interpretation and dispute resolution of this Agreement.

d. Any dispute or controversy arising out of this Agreement or the Apollo-Explorer Platform Services shall be resolved through friendly negotiation; in the event that such negotiation fails, you agree to submit the dispute or controversy to the arbitration and jurisdiction of Hangzhou Arbitration Commission and final arbitration shall be conducted in accordance with the arbitration rules of the said Commission as in force at that time.

e. The headings of all the provisions in this Agreement are for reading convenience only and have no actual meaning in themselves and cannot be used as the basis for interpreting the meaning of this Agreement.

f. If part of this Agreement is invalid or unenforceable for any reason, the remaining provisions shall remain in force and shall be binding on both parties.
